Plain terms for a plain service. If anything here is unclear, ask before you agree to it: coaches@granite.coach.
Who you are dealing with
Granite for coaches is provided by [Trading name], [Postal address], United Kingdom (“we”). You are the coach or personal trainer who creates an account (“you”). These terms apply from the moment you create one.
The service
A service that drafts training weeks for your clients from parameters you set, puts each week's proposed changes in a queue for your review, and lets your clients log their sessions on their phone under your name. It drafts; you decide. Nothing goes to a client that you have not released.
Your account
One account per coach. Keep your password to yourself; you are responsible for what is done under your login. Tell us straight away if you think it has been used by someone else.
Fees
Setup is free. The service is priced per coach, not per client: £59 a month up to 15 clients, £119 up to 50, or £179 unlimited. [VAT is / is not] included. A 14-day trial starts when you pick a plan; nothing is charged until it ends, and you can cancel before then and pay nothing. After the trial, you can cancel any month; the current month is not refunded, and nothing further is charged. We give at least 30 days' notice of any change to your price or tier.
Your responsibilities
You are the coach. You review what the engine proposes and you decide what goes out. You are responsible for the suitability of the training you release to each client, for holding the qualifications and insurance your work requires, and for having your clients' agreement to their information — including injury and pain notes, which are health data — being held on the platform on your behalf.
Our responsibilities
To run the service with reasonable care and skill; to keep your data and your clients' data secure and use it only as the privacy policy says; to tell you about material changes before they happen; and to give you your data when you ask for it.
Data
For your clients' data you are the controller and we are your processor under UK GDPR. We process it only on your instructions, only to run the service, and only for as long as you have an account. We apply the security measures set out in the privacy policy, tell you of any breach affecting your clients' data without undue delay, help you respond to your clients' requests about their data, delete or return it when your account closes, and use only the sub-processors listed in the privacy policy. This paragraph is the data processing agreement between us.
Not medical advice
Granite is a programming tool. It is not a medical device and nothing it produces is medical advice. Strength training carries risk; you and your clients are responsible for deciding what is appropriate, and for seeking medical advice where it is needed.
Availability and changes
We aim to keep the service available, but cannot promise it will never be interrupted. We may improve or change the service; if a change removes something you rely on, we tell you first. We may suspend an account that is being used to harm the service or others.
Ending
You can close your account at any time by email. We can end these terms with 30 days' notice, or immediately if they are seriously breached. Either way you can take your data with you.
Liability
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Otherwise our liability to you in any twelve months is limited to the fees you paid us in those twelve months, and we are not liable for loss of profit or business.
Law
These terms are governed by the law of England and Wales, and its courts have jurisdiction.
